This hotel was acquired as Wingate in 2021 under an SBA 7(a) loan but was converted into a Comfort Inn which required a major renovation that impacted the occupancy and the cashflow. When the revenue and the profit drops, financing through the conventional loan program specially at a higher LTV (Loan to Value) will be more difficult specially in our current capital market where banks are very tight on commercial real estate loans. Due to the drop of revenue, Scientific Capital was planning on refinancing this loan through the SBA 504 program on projection basis, however, when the SBA CDC was entering the information into the SBA system to obtain approval, it encountered the SBA Error Code 4363. The majority of the SBA Error Codes are cleared quickly by obtaining the 2019 IRS tax return transcript of any hotel/business with the EIDL loan and by sending it along with the full 2019 tax return to the 4363resolution@sba.gov for auditing. Although Scientific Capital has helped several clients resolve the SBA 4363 Error Code in a fairly short period of 30 to 60 days, in some instances, the clearing of the code may take longer than the loan process will accommodate. In this project, we realized that the process would be lengthy, but we were able to persuade the bank to refinance the entire 4 million SBA 7a loan under the conventional program with 25-year amortization and 6.95% fixed rate for five years. Scientific Capital has reached the SBA Ombudsman and has requested SBA to show the 4363 Error Code on the MYSBA portal to allow EIDL borrowers to clear the 4363 Error Code before they apply for an SBA loan but this change has not taken place yet.
